Workplace Notice

WORK PLACE REQUIREMENTS

A multitude of federal and state laws require employers to post certain notices in a conspicuous area in the workplace setting forth various laws, rights and other information. Confusion as to what notices, facts or information must be posted is inevitable since the posting requirements are based on numerous factors, such as, the nature of the employer's business, the number of employees, the occupation of the workplace and the actual workforce characteristics. This article provides a general outline of the required notices.

All employers are required to post:

Federal Minimum Wage Notice
Worker's Compensation Notice

Those employers who are government contractors or subcontractors must also post:

Equal Employment Opportunity Law Notice
Notice to Employees Working on Federal or Federally Financed Construction
Projects of certain rights.
Notice to Employees Working on Government Contracts

Those employers engaged in a business affecting commerce or producing goods for commerce (not including federal, state, or political subdivisions of states) must post:

Job Safety and Health Protection Notice
Notice: Employee Polygraph Protection Act

Other notices may be required depending on a particular kind of business, the number of employees or the presence of disabled employees. These notices include:

Notice to Workers with Disabilities Paid at a Special Minimum Wage
Notice of Your Rights Under the Family and Medical Leave Act
Federal Minimum Wage
Notice Migrant and Seasonal Agricultural Worker Protection Act

Each state may also have notice requirements in addition to those under federal laws. For example, Maryland also requires that an employer visibly display the:

Wage & Hour Fact Sheet
Equal Pay for Equal Work
COBRA Coverage
Unemployment Insurance Notice

This outline of notice requirements is not all inclusive. Also, as existing laws are amended or new ones created the notice posting requirements may change. Many of the notices to be posted can be obtained from the U.S. Department of Labor. Please be sure to give us a call if you have questions as to the posting requirements of your particular company.
